DBA stands for ‘doing business as’. This acronym is also referred to as your business fictitious or trade name. This is why filing for a business name or DBA for your business will eventually be your business identity in the long run.

According to The Law Advisory Guide, the benefit of filing for a DBA will allow you to have business ventures under a name that is different from your business. A DBA is one that is mostly different from your original business name as an owner or as a registered corporate name. This is because the name in which a business is registered automatically becomes the identity of the person that runs the business. People start calling the person with the business name he or she is associated with. Such as Abbott Laboratory named after Wallace Calvin Abbott

This happens because a business is registered under a legal entity without being registered under DBA. To put it simply, let’s take an example for it.

An entrepreneur Laura Smith wants to start a tech and repair shop. Unless Laura d registers a DBA for her tech repair shop, the business will operate under her name. Laura then chooses a DBA with the credentials ‘Laura’s tech and shop’. Now, the business will legally operate under the registered DBA and is not associated with Laura’s full name.

Plus, it also needs to keep in mind that your state may have an additional requirement for registering your business under DBA. Therefore, you need to comply with it to smoothly run your business legally.

What Kind of Business Needs to Register under DBA?

Typically, not all businesses require DBA. The need for DBA may entice a business after a combination of legal business entities, the preferences of the business owner(s), and the state requirements.

Partnerships and Sole proprietorship

If you run your business under a proprietorship or along with a partnership, you really want your business to have a proper business name that is not yours or your partner’s legal name. This is because general partnerships and sole proprietorships are not obligated to file business entity names or entity formation papers with the state. However, they will still need a business license to work and a legal permit to operate a business in their state.

Therefore, if the owner of the business does not file for DBA, their business name and the owner will be assumed as a single legal entity.

Do Franchises Need DBA?

Franchise owners don’t actually need to register a DBA. They file their business as a local business identity. Franchises are locally formed LLCs or corporations as they need to file their franchise under an LLC business, ABC Business LLC for instance. So for example, you buy a local business ‘Burger King’ franchise, so you have to name your DBA as ‘Burger King’ to form an identity in your state that you have joined the ‘Burger King’ franchise.

Filing a DBA Name for Your Business

The required documents and filing procedure for DBA differ across states, regions, and countries. But filing the DBA for your business often comes with a filing fee between $10 and $100.

This can be done easily by working with your county’s office clerk or you can contact your state government in order to finalize your paperwork and DBA filing. Depending on your state requirements, you may need to place an ad for your DBA name in a local newspaper in order to get your DBA name’s official placement.

One thing that should be notable here is that your ‘doing business as’ name filing cannot have the ending acronyms like Inc., Corp., or LLC. This is because this will give the impression that you are a business entity and working under a corporate statute.

Otherwise, there are no limitations when it comes to filing your business as a DBA. You just have to do a deep search before selecting a DBA name for your business to make sure that there’s no other business with the same name.
